Terms & Conditions

The terms that govern your use of the FNQ ADVANCE website and our AI automation services.

Last updated: 2 October 2026

1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the FNQ ADVANCE website and the AI automation services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, you may not use our website or services.

“You” refers to the individual or business entity engaging our services. “We”, “us”, and “our” refers to FNQ ADVANCE.

2. Our Services

FNQ ADVANCE provides AI automation services for home service and local businesses, including but not limited to: AI receptionists, AI chatbots, AI voice agents, missed call text back, lead capture and qualification, appointment booking and scheduling, automated customer follow-ups, SMS and email automation, CRM and pipeline management, website and live chat automation, sales and marketing automation, workflow automation, AI-powered customer support, CRM setup and management, and custom business automation solutions.

The specific scope, deliverables, and pricing of services for each engagement are set out in a separate proposal, statement of work, or invoice agreed between you and us. In the event of any conflict, that agreed document governs the specific engagement.

3. Engagement & Payment

Pricing, setup fees, and recurring subscription fees are described on our pricing page or in your service agreement. Unless otherwise agreed, recurring fees are billed monthly in advance.

Payment is due within the timeframe stated on your invoice. Late payments may result in suspension of services. Fees are generally non-refundable once setup work has commenced, except where required by law or explicitly stated in your agreement.

Custom or “Scale” engagements are quoted based on scope and may be subject to separate milestones, deposits, and payment terms.

4. Your Responsibilities

To allow us to deliver our services effectively, you agree to:

Provide accurate, complete, and timely information about your business, call flows, lead sources, and systems;

Grant necessary access to the accounts, platforms, and tools required to configure and manage your automations;

Ensure you have the right and permission to share any customer or lead data with us for the purpose of delivering the service;

Comply with all applicable laws, including those relating to telemarketing, SMS, email, privacy, and consumer protection;

Maintain any required consents from your customers for the communications and automations we deploy on your behalf.

5. Compliance & Acceptable Use

You agree not to use our services for any unlawful, fraudulent, or abusive purpose, including sending unsolicited spam, harassing communications, or violating the terms of the third-party platforms we integrate with. You are responsible for the content of messages sent through automations we configure on your behalf and for ensuring recipients have consented where required.

SMS, email, and voice automations are subject to carrier, platform, and regulatory rules. You acknowledge that non-compliance may result in message blocking, account suspension, or penalties imposed by third parties, and that we are not liable for such actions.

6. Third-Party Platforms & Tools

Our services often integrate with third-party platforms such as CRM, communication, calendar, SMS, email, and automation tools. We do not control these platforms and are not responsible for their availability, performance, changes, or policies. You are responsible for maintaining your own accounts and subscriptions with any required third-party platforms, and for complying with their terms.

7. Intellectual Property

All content on our website — including text, graphics, logos, and design — is owned by or licensed to FNQ ADVANCE and protected by intellectual property laws. You may not copy, reproduce, or redistribute it without our written permission.

Custom automations, workflows, and configurations built specifically for you become yours to use within your business upon full payment, except for any underlying third-party platform functionality or pre-existing templates we license. We may retain the right to use generic methods, techniques, and tools developed during your engagement for other clients.

8. Disclaimers & Warranties

We commit to providing our services with reasonable skill and care. However, our services are provided “as is” and we do not guarantee specific business outcomes such as a particular number of leads, bookings, or revenue.

AI-generated responses may occasionally be inaccurate or incomplete. You are responsible for reviewing and approving configurations and for monitoring the performance of automations deployed on your behalf.

We do not warrant that our services or website will be uninterrupted, error-free, or free from harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, FNQ ADVANCE shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business, arising out of or related to your use of our services.

Our total aggregate liability for any claim arising from our services is limited to the amount you paid us for the service giving rise to the claim in the three months preceding the event. This limitation does not apply to liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold FNQ ADVANCE harmless from any claims, damages, or expenses arising from your misuse of our services, your breach of these Terms, your violation of applicable laws or third-party rights, or the content you provide for use in automations.

11. Suspension & Termination

You may terminate recurring services subject to the notice period stated in your agreement. Setup fees are generally non-refundable.

We may suspend or terminate services if payment is overdue, if you breach these Terms, or if continued service would violate law or third-party platform rules. Upon termination, access to configured automations and any related data may be discontinued, and you are responsible for exporting data you wish to retain from the relevant platforms.

12. Confidentiality

Each party agrees to keep confidential any non-public information shared during the engagement, including business information, customer data, and pricing. This obligation survives termination of the engagement.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “last updated” date. Your continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which FNQ ADVANCE operates, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise agreed in writing.
